The contribution between spouses who are the subject of a crime is a right granted only by law. There is no usual right to contribution among the injured parties.5 Fla. Stat. Section 768.31 entitled “Contribution Among Offenders” provides in a relevant section: Compensation is a comprehensive form of insurance compensation for damage or loss. If the term compensation is used in the legal sense, it may also refer to an exclusion of liability for damages. The case involving the Department of Sanitation employee was essentially a lawsuit against his employer for injuries caused by a defective product. (The plaintiff had a viable cause of action against the city, his employer, because the Workers` Compensation Act did not apply to the Department of Sanitation at the time.) As a result, customary and legal obligations applied to the city (as an employer). The City, as a common law employer, agreed with the employee because of its non-delegable legal and customary obligations. The city, in turn, claimed compensation from the manufacturer. Conclusion The boundary between remuneration and common law contribution can be opaque and definitions in case law (and legislative systems) vary. It is therefore advisable to proceed with caution and familiarize yourself with the laws of the respective jurisdiction before taking any positive measures. Trust in a contractual arrangement is also not enough. A deeper understanding of the effect of the disposition is needed to determine if the remedy you are looking for is really viable.

The right to compensation may be implied by legal obligation in situations of liability of the vicarious agent or by express contract.
